I want to take the guesswork out of selling your car. I analyze market data, decode DMV title laws, and test out online car buyers to give you a straight answer on whether it's worth holding out for a higher price or if you're better off taking the most convenient offer and moving on.

The bottom line: To sell a car privately in Idaho, sign the title over to the buyer and write the sale price in its space on the title, which makes a bill of sale unnecessary. For a 2011 or newer car, record the odometer reading there too.

No notary is needed. If the owners’ names are joined by “and”, all of them sign.

If you still owe on the car, the lender has to release the lien, on the title or in a separate written release. If the title is lost, apply for a duplicate (Form ITD 3367) at your county assessor’s motor vehicle office, or for a 2010 or older car, sell it with Form ITD 3369, the duplicate title application with ownership transfer.

Take the plates off and keep them. Within 5 days of the sale, file a release of liability online or with Form ITD 3858 at your county assessor’s office. Until you do, tickets, towing and damage involving the car can still come back to you.

Step-by-Step Process for Idaho

Step 1: Prepare Your Idaho Paperwork

Documents you’ll need:

  1. Vehicle title – the Idaho certificate, in your name, with any lien cleared
  2. Driver’s license – yours, and a look at the buyer’s before money changes hands
  3. Lien release – only where a lender is still shown on the title record

If your title is missing:

Start this before the first photograph goes up. The duplicate comes back by mail, and nothing else in the sale can move until it does.

The form is Form ITD 3367, and it goes to your county assessor's motor vehicle office. The fee is $14 state title fee plus your county's title admin fee, which runs from $0 to $15, and rush service adds $26.

One catch sends applications back. Do not sign it at home: the signature has to be notarized, or witnessed by an assessor or deputy assessor, or the ITD will not process it. Signing at the county counter costs nothing.

Once the duplicate is issued the original is void, so there is no going back to it if the old one turns up.

If you can’t get a duplicate title:

There is one narrow exception, and it is written into the code. Idaho Code section 49-502 subsection 2 allows sale without a physical title for qualifying vehicles by delivering a completed duplicate title application with assignment of ownership.

A car that does not meet them has no route round the title, and a buyer cannot register on a bill of sale alone.

If you still owe money on the car:

The lender clears the lien first, and nothing about the sale is possible until they have. On an Idaho loan the lienholder usually holds the title and will not let go of it before the balance is paid.

How the release itself is recorded: the lienholder signs the release on the title record, or attaches a separate written release; on an electronic title, ITD prints the paper title and mails it to the customer the day after the lien is released.

Ask what their turnaround is before you advertise. If the payoff is larger than the car will fetch, you cover the difference on the day.

Step 2: Prepare Your Car

Idaho puts a private car through no inspection of any kind before it is sold, so the buyer judges it on what you show them.

Wash it, clear it out, and put the service receipts in one folder they can turn through.

Pull the history report yourself first. It is better to know what it says before the buyer does.

Step 3: Price Your Car

Take a number from KBB and Edmunds, then go and look at what the same year and trim is being asked around Boise and Coeur d’Alene.

The two tools will disagree with each other. A buyer will quote the local asking prices back at you.

Step 4: Advertise Your Car

Facebook Marketplace, Cars.com and Autotrader all reach Idaho buyers, and naming Boise, Meridian, Nampa or Idaho Falls covers where most of them live.

Write the ad for someone driving in from Washington, Oregon, Utah, Wyoming, Nevada or Montana as well.

An older car has nothing to pass first. Idaho ended its state-required vehicle emissions program effective July 1 2023.

If you would rather not have strangers in the driveway at all, Peddle and Wheelzy buy old and damaged cars outright, and Carvana is the one to try for a car under 10 years old in good condition.

Step 5: Meet with Buyers Safely

Meet somewhere busy, where other people can see you. A bank parking lot in daylight, or a supermarket, and not your own street.

Look at the buyer’s license before the test drive, and go along for it.

Step 6: Handle Payment and Negotiate

The easiest version is to meet inside the buyer’s own bank and let the cashier confirm the cashier’s check while you are both standing at the counter.

A wire works too, once the money is sitting in your account rather than in a screenshot of theirs.

Cash is fine. Count it indoors, and sign nothing until it is settled.

Step 7: Complete the Idaho Title Transfer

The assignment on the back of the title is the sale. Fill it in with the buyer standing there, and take your time, because Idaho’s route for changing a filled-in title is another trip to the county office.

What goes in: the date you are handing the car over, the buyer’s full legal name and address, the price you agreed, the mileage, and your signature, exactly as your name is printed on the front.

Sale price:

Write the real one. Idaho makes a false selling price on a title or a bill of sale a felony, and the ITD and the State Tax Commission can look the fair market value up and compare.

Odometer reading:

Disclosure is required for model year 2011 and newer vehicles weighing under 16,000 pounds; model year 2010 and older vehicles, trailers and vehicles over 16,000 pounds are exempt.

Made a slip?

Idaho’s route is a form rather than a fix in place: a title that needs information changed goes back on Form ITD 3371, the Affidavit of Lost Title, with at least one owner remaining on the title; where ITD issued the title with an incorrect owner name, lienholder or vehicle description, the owner resubmits it with a signed letter of explanation.

Signing for someone else?

Bring the document that authorizes it, such as a power of attorney. Idaho will not issue a title until the original, or a certified copy, reaches the county office.

After you sign:

Hand the title to the buyer yourself rather than posting it on afterwards.

Step 8: What Happens to Your Idaho License Plates

The plate never goes with the car. It belongs to the person rather than the vehicle, and the ITD wants it off before the buyer pulls away.

The plate then has somewhere to go: take the plates off the vehicle and keep them; they can be transferred to another vehicle titled to the same owner with credit for any remaining time on the registration, except black and white restricted plates.

A plate of their own comes with the registration the buyer pays for.

Step 9: Submit the Release of Liability

File online at dmvonline.itd.idaho.gov for immediate processing, or submit Form ITD 3858 with a $3.50 fee by mail or in person at your county assessor's motor vehicle office.

Online is worth the click. The ITD processes an online notice immediately, where a posted form waits for the county to open it.

Whichever way it goes in, the ITD wants the odometer reading at the sale, the price and the date you handed the car over, so note those three down before the buyer drives off.

Until it is filed, what stays open is liability for death or injury, property damage, motor vehicle infractions, towing, storage, repair or service charges involving the vehicle after it is delivered to the purchaser.

Step 10: Cancel Insurance

Keep the policy running until the title is signed, the plate is off and the release is filed. Cancel it after that, and do not wait on the buyer: their deadline for applying for a title is theirs, not yours.

Frequently Asked Questions

How long does the buyer have to transfer the title after we complete the sale?

The clock starts the moment the title is signed and handed over, and it runs 30 days from transfer.

Within that time the buyer takes the signed title to a county assessor’s motor vehicle office and applies for one in their own name.

Miss it and the penalty is theirs, not yours: $20.00 late-filing penalty.

Registering the car is a separate thing. Idaho charges the title penalty whether the vehicle was registered or not.

Can you sell a car without a title in Idaho?

Only if the vehicle is old enough or unusual enough to qualify. The conditions are the vehicle must be a 2010 or older model year, weigh over 16,000 pounds gross vehicle weight, or have no odometer device.

Form: Form ITD 3369 (Duplicate Idaho Title Application With Ownership Transfer).

Two things catch people out on this route. The seller’s signature on the application has to be notarized, and the buyer has to be an Idaho resident, or no title will be issued.

If the car does not qualify, a duplicate title comes first. Nothing else will do, and no bill of sale replaces it.

Is a bill of sale required to sell a car in Idaho?

A bill of sale is recommended in Idaho, and there is one case where it is not needed at all: optional; no bill of sale is required if the seller enters the sales price on the title in the space dedicated for it, and where one is used Idaho provides Form ITD 3738.

A bill of sale records the price. The buyer takes it to the county office as proof of what they paid, and Idaho collects sales tax on that figure, so where the title already carries the price that job is done.

Whichever document carries the price, write the true one. A false selling price on either is a felony in Idaho.

A usable one names the vehicle, the price, the buyer’s full legal name, the date, and carries your original signature. Our free bill of sale generator produces one in a couple of minutes.

Both my spouse and I are on the Idaho title. Do we both need to sign?

It depends on the word printed between the two names: any owner may sign if the names on the title are connected by "OR", but all must sign if they are connected by "AND".

Check the front of the title before the buyer arrives, so the right people are in the room.

The buyer is from out of state. Does Idaho require anything special?

Nothing changes on your side of it. Sign the title, take the plate off, and file the release on the same clock as you would for a buyer in Twin Falls.

Titling the car is their problem, under their own state’s rules.

It is worth knowing which way Idaho’s own inspection rule points, because sellers get this backwards. Idaho wants a VIN inspection on a car arriving from another state or never titled here before, done by a police officer, a DMV employee, a military police officer or an Idaho licensed dealer. That applies to cars coming in, not to yours going out.

Do Idaho license plates transfer to the buyer?

No, and leaving them on to help the buyer drive home does the opposite of helping.

A plate left on the car is still registered to its old owner while the buyer is driving it, which is exactly the exposure the release of liability exists to close.

Do I need to file a release of liability after selling my car in Idaho?

Yes. What makes it matter is the ITD’s own wording: the motor vehicle record stays in your name until the buyer applies for and is issued a new Idaho certificate of title.

Filing it is what puts the sale on the record while the buyer takes their time.

How do I gift a car to a family member in Idaho?

The buyer is paying with a loan from their bank or credit union. What changes for me?

Possibly nothing, and possibly one less trip for the buyer. Where a private sale carries a lien from a financial institution, the ITD says that institution may prepare the application for title and file it themselves. If they do not, the buyer files it at the county office like anyone else.

Your side is unchanged. Sign the title over, take the plate, and file the release on the usual clock.

Wait for the money to land before the title moves. A lender’s check is still a check until your own bank has it.

My Idaho car is barely worth anything. Is a private sale still worth the trouble?

Some cars are worth less than the trouble of listing them. Buyers in Idaho typically offer $488 for a junk car (cars 10 years and older, 54 offers, ranked 28 of 44 states), and an online buyer will tow it rather than make you show it to strangers.
