The bottom line: This page lists the official motor vehicle agency for all 50 states, plus the forms and fees you need to sell a car. Each section covers the same six things: replacing a lost title, whether the title needs notarizing, bill of sale rules, what happens to your plates, how to report the sale, and whether emissions testing applies.

Check your state’s section first, because requirements vary a lot. 18 states require a bill of sale at all, seven want the title notarized, and the two rules have nothing to do with each other.

What changes from state to state

  • The title. Nearly every state needs a signed title to transfer a car. These exempt older vehicles and take a bill of sale instead: Alabama, Connecticut, Georgia, Maine, New Hampshire and Vermont.
  • Notarization. Seven states need the seller’s signature on the title witnessed by a notary: Kentucky, Louisiana, North Carolina, Ohio, Oklahoma, Pennsylvania and Wyoming. A notarized bill of sale is a separate rule, and it comes up in Louisiana, Maryland, North Dakota, Tennessee and West Virginia.
  • The plates. In most states they come off with you. In five they stay on the car instead: Alaska, California, Hawaii, Minnesota and Oregon.
  • Reporting the sale. Most states want a filing after the car is gone, with deadlines ranging from a few days to a month. This is what stops tickets and tolls following you, and your state’s row below gives the form and the deadline.
  • Emissions. In most states this is the buyer’s problem. It attaches to the sale itself in California, Colorado, Georgia, Missouri and New Mexico, and several of those only inside certain counties.
  • Replacement title cost. Fees range from a few dollars to the better part of a hundred, and processing runs from same day to several weeks. If your title is missing, start that before you list the car.
